Competition Rules / Terms & Conditions

The following constitutes the Rules, Terms and Conditions of the Rising Talent Competition. By applying to take part in the Competition, you confirm and agree to the terms and details outlined below.

How to Enter

Entry is Free and all entrants must be aged between 12 and 45 years old as of July 1st 2016. To take part, you need to provide the following through our website’s application form:

  • Enter your name, email address, website address, contact phone number and a short biography.
  • Provide a caption to your video and a description of the meaning of the song if applicable and a link to your video on Vimeo or Youtube. Please provide just one entry per person. You must ensure that your video remains live on your preferred site for the duration of the competition.
  • Ensure you read and agree to the Terms and Conditions of the Competition outlined on this page before submitting your application as submission is deemed acceptance of these terms and conditions.
  • Submissions shall not contain disparaging remarks about any persons, products or companies. Submissions shall not contain materials which are not created entirely by the Entrant or which are owned by others (other than specific audio assets or materials which the Entrant owns a license to use commercially such as a purchased sample pack). And Submissions shall not be in violation of any law.

Competition Stages

The competition consists of two stages, online and on the day of September 10th 2016.

Online – Stage 1

Entries and videos uploaded prior to September 1st 2016 will be a part of Stage 1. No videos will be accepted after the 1st of September 2016.

All entries received before September 1st will be eligible to enter stage two if they meet the following criteria

1/ The top 8 performers based upon Shares and Likes will be invited to come to Brisbane to perform at their own expense on stage at the Country Music Race day being held at Doomben Racecourse.

2/ Videos can only be voted on once per day.

September 10th 2016 – Stage 2

Each performer chosen in the top 8 based upon the above criteria and able to attend will be asked to perform their video song on the day in front of judges and audience. The song of each applicant will be listened to by all of our Judges, and they will independently cast their votes on each song with the approach to judging being on melody, composition, performance, originality and lyrics (where applicable). The combined votes of the Judges will determine the Competition Winner and the winner will be announced on the day, September 10th 2016. The decision of the Judges is final.

The WINNER will receive

  • Two return economy class airfares including taxes and charges from Brisbane International Airport to Nashville Tennessee.
  • 7 Nights accommodation on a twin share basis in Nashville
  • A Tourist Pass to 31 sights in Nashville

The airfare and accommodation redemption are limited to Low and Shoulder Season as stipulated by the airline chosen and property at time of booking. Black Out peak periods around Christmas and other peak times exclude redemption at this time.

Promotion of Videos

Entrants are able to promote their own entry by any means possible excluding any paid advertising. Any paid promotion of an entry will see that entry excluded from the competition.

Granting of Rights

By entering into the Competition, each Entrant agrees and grants the rights to Rural Aid Ltd to use all submitted information, data and material in connection with their application in the Risingtalent.com.au website and in the promotion, marketing, advertising and publicity of the competition by Rural Aid Ltd or agents acting on its behalf. Personal information such as your name and email address will not be made public or shared with third parties outside of Rural Aid Ltd and its agents unless required to by law.

By entering into the Competition, each Entrant agrees and grants the rights to Rural Aid Ltd to use all submitted information, data and material in connection with their application, excluding personal information such as your name and email address, in the promotion of the Competition on third party websites and networks.

By entering the Competition, the Entrant acknowledges that all songs, information and media submitted to the Competition may be distributed to the Judges and used, as necessary, in their role of determining whether an Entrant remains in the Competition, becomes a Winner or is rejected from the Competition at any stage.

The Entrant retains all ownership right to all submitted songs. Rural Aid Ltd will not have any ownership rights to any songs submitted. However Rural Aid Ltd will reserve the right to use the songs and videos fruit of the recordings at the Rural Aid Ltd event, for promotional use and for possible music releases such as compilations.

By participating in the Competition, Entrants release Rural Aid Ltd , its Sponsors, Judges and other agents from any and all claims, damages or liabilities arising from, or relating to, such Entrant’s participation in the Competition, and agree to resolve any dispute individually, without resort to any class action.

Competition Winner

Entry to the competition constitutes permission to use the winners’ name, likeness and voice for future advertising and publicity purposes without additional remuneration or compensation.

The Winner may be required to send a copy of his/her passport, drivers’ license, birth certificate or other official legal or governmental document as proof of age and residency. In the event that a Winning Entry is a minor (under the age of 18), then the parent(s) or legal guardian(s) of the minor will be required to sign and return the Affidavit of Eligibility and Liability/Public Release as a condition of such minor Winning Entry being declared a Winning Entry.

If a Winner rejects his/her prize; or in the event of non-compliance by the Winning Entry with these Competition Rules; or if the Affidavit or Eligibility and Publicity/Liability Release is not properly executed, then the Winner shall be disqualified and shall forfeit the Competition prize.

If a prize cannot be awarded for any reason related to the Entrant’s actions or inability to receive the prize, it will be forfeited.

By accepting a prize in the Competition, the Winner agrees that Rural Aid Ltd, its Sponsors, Judges and other agents shall not be liable for any loss or injury resulting from participation in the Competition, acceptance, or use of any prize, or any travel related thereto.

The Winner grants permission to Rural Aid Ltd and those acting under its authority to use his/her name(s), photograph, voice and/or likeness, for advertising and/or publicity purposed, as well as the Submission in any and all media now known or hereinafter invented without territorial or time limitations and without compensation.

Limitations of Liability and Release

No liability or responsibility is assumed by Rural Aid Ltd, its Sponsors, Judges or other agents resulting from an Entrant’s participation in, or attempt to participate in, the Competition, or downloading any information in connection with participating in the Competition. No responsibility or liability is assumed by Rural Aid Ltd, its Sponsors, Judges or other agents for technical problems, or technical malfunction which may affect the operation of the Competition, including by not limited to any of the following occurrences: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Website, in whole or in part for any reason; traffic congestion on the Internet or the Website; unauthorized human or non-human intervention of the operation of the Competition, including without limitation; unauthorized tampering, hacking, theft, viruses, bugs, worms; or destruction of any aspect of the Competition, or loss, miscount, misdirection, inaccessibility of unavailability of an account used in connection with the Competition.

Rural Aid Ltd, its Sponsors, Judges or other agents are not responsible for any typographical errors in the announcement of prizes or these Competition Rules, or any inaccurate or incorrect data contained on the Website. Use of the Website is at the user’s own risk. Rural Aid Ltd, its Sponsors, Judges or other agents are not responsible for any personal injury to the Entrant, or property damage or losses of any kind which may be sustained to the Entrant’s or any other person’s computer equipment resulting from participation in the Competition, use of the Website or the download of audio assets or materials, or any other information or data from the Website. Rural Aid Ltd, its Sponsors, Judges or other agents are not responsible for any attempt by an Entrant or other individual to deliberately damage or undermine the legitimate operation of the Competition, including but not limited to, any fraudulent claims, which may be a violation of criminal or civil laws. Should such an attempt be made, Rural Aid Ltd, its Sponsors, Judges or other agents reserve the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Entrants engaging in any of the aforementioned activities may be disqualified from the Competition at Rural Aid Ltd’s sole discretion.

The Entrant agrees to release, indemnify and hold Rural Aid Ltd, its Sponsors, Judges and agents harmless for liability, damages or claims for injury or loss to any person or property relating to, in whole or in part, directly or indirectly, by participation in the Recording Festival Competition.

By entering the Competition, the Entrant, and/or their parent(s) or legal guardian(s) (if such entrant is a minor) agree to accept and be bound by the decision of Rural Aid Ltd and its Judges, which are final and binding in all matters.

Failure to enforce any term of these Competition Rules by Rural Aid Ltd, its Sponsors, Judges or other agents shall not constitute a waiver of that provision.
